PLEASE READ THESE CONDITIONS CAREFULLY BEFORE ORDERING FROM US.

PLEASE BE AWARE, HOWEVER, THAT NOTHING IN THESE CONDITIONS AFFECTS YOUR STATUTORY RIGHTS AS A CONSUMER.
ACCEPTANCE OF YOUR ORDER
Whilst our website and brochure allow you to send your order information to us to process, a contract between us will only exist once your order has been accepted, processed and despatched by us. These terms and conditions will apply exclusively to the contract between us and you, which contract will exist once an order from you has been accepted and processed by us. Any such contract, and these terms and conditions, are governed by English law and any dispute shall be subject to the jurisdiction of the English Court. All contracts will be concluded in English.
AVAILABILITY AND DESCRIPTION OF GOODS
All goods are subject to availability. However, we will inform you as soon as possible if the goods you have ordered are not available. While we try to ensure that the description of our goods (including the specifications and colour reproduction) are accurate, errors may occur. We are afraid we cannot accept any responsibility for any such error although if the goods do not meet your expectations, we are happy for you to return the goods in accordance with our returns policy detailed below. We also do our best to keep the prices on our website and in our brochures correct and up to date; however, again, we are not always able to achieve this. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and will give you the option of reconfirming your order at the correct price or cancelling it. If, for any reason, we are unable to contact you, we will treat the order as cancelled. In any event, if the order is cancelled and you have already paid (in full or in part) for the goods, we will refund to you any payments made.
DELIVERY CHARGES AND TIMESCALE
Our delivery charge within mainland UK is just £4.95, no matter how large your order. We are afraid that, currently, we do not usually deliver outside the mainland United Kingdom or to Northern Ireland, the Channel Islands, Isle of Man, Orkney, Shetland, Scottish Islands or BFPO addresses – however, if you do wish to receive goods outside of mainland UK, we will try to assist so please contact us for an individual quote. Delivery charges cannot be refunded unless the goods you receive are faulty and you chose to cancel your order or you chose to exercise your legal right to cancel (see "Your right to cancel"). Any replacement or exchanged items will be delivered to you free of charge. We aim to deliver all accessories and gifts within 3-5 days of receiving your order and we take all reasonable steps to meet these estimated timescales. However, occasionally, the availability of your goods may be delayed for reasons beyond our control (such as material shortages, import delays or higher than anticipated demand) so all delivery dates are estimates only and cannot be guaranteed and we cannot accept any liability for any direct or indirect loss or damage resulting from delivery outside of these estimated timescales. We will, however, make every effort to keep you informed of any such delays. Where (in very rare circumstances) we are unable to deliver the goods within 30 days of the delivery date you arranged with us, you may cancel your order.
PRICES AND PAYMENT
All prices quoted are in pounds sterling (£), are inclusive of VAT and are accurate at the time of publication. If you are ordering through one of our brochures, you can pay by cheque or by any debit or credit card. We accept online payment in a secure environment by debit or credit card - we currently accept Visa, Mastercard, Delta, Switch and Amex.
ORDERING PROCESS AND ERRORS
If you are ordering through our website, your order will be placed when you press the "confirm order" button at the end of the checkout process and you are able to correct errors on your order up until this point. However you order, if you have supplied us with a valid email address, we will notify you by email as soon as possible to confirm receipt of your order. We will also let you have details of how you can track your order. This is not an order acceptance, which will take place on the despatch to you of the goods.
CHANGING AN ORDER
If you wish to change an order prior to delivery of the goods, we will do what we can to assist you. Please contact one of our customer service advisors on 0845 850 4256 or by email to customerservices@haloliving.co.uk. Please be aware, however, that if we are able to change an order for you, the delivery time and the price you have been quoted may change as a consequence.
YOUR RIGHT TO CANCEL
If you order online, over the telephone or by mail order, you also have the legal right to cancel your order within 8 working days of delivery. We will refund (within 30 days) all monies paid by you to us, provided you cancel the contract within the required time and return to us the goods you ordered in perfect condition. We recommend that you return the goods in or with the original packaging to ensure that the goods are not damaged on their return journey. Please see our "Returns Policy" for details of how to return goods.
RETURNS POLICY
If you are not happy with the goods that you have chosen, you may return them to us within 28 days of receipt and we will willingly offer you an exchange or a refund (if cancelled within your legal rights), provided that the goods are returned in perfect condition, unused and ideally in or with the original packaging (together with the original receipt/delivery note). When returning any goods (except where the item is faulty) it is your responsibility to arrange, and pay for, the return of the goods to us. If you fail to return the goods and we have to arrange for the goods to be collected from you, please be aware that the cost of this will be charged to you and may be deducted from any refund to you. We cannot accept responsibility for goods lost in transit so we strongly recommend that you send the goods by recorded delivery or obtain some other proof of posting. We make every effort to ensure that goods arrive in a good condition. However, in the event of goods being faulty or damaged, please contact us on 0845 850 4256 or by email to customerservices@haloliving.co.uk as soon as possible following receipt of the goods (and, in any event, within 8 days). Our aim is to respond to all customer queries within 1 working day of receipt. Our customer service working hours are 9am to 5pm.
LIMITATION ON OUR LIABILITY
We do not seek to exclude or limit liability for death or personal injury arising from our negligence or that of our agents, directors or employees or for any fraudulent misrepresentation. Other than this, however, to the fullest extent permitted by law, neither we nor any of our associated companies shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract between us, or in negligence (whether on our part or on the part of any of our members, agents, directors, employees or otherwise) for any indirect, special, economic or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with your use of this website, the supply of the goods or their use by you. For the avoidance of doubt, except as expressly provided in these conditions, our entire liability under or in connection with any contract for any goods to which these terms and conditions apply shall not exceed the price of the goods. The limitations of liability in these terms and conditions shall apply equally for the benefit of us and any of our associated companies as if references to us included references to each such associated company.

If you are purchasing goods via our website, we would draw your attention to our Terms of Use and Privacy Policy and any other legal notices on this website relating to your use of this site, all of which are deemed to be incorporated into these terms and conditions.
INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights existing in our designs and products are and will remain the property of Halo. Any infringement of these rights will be pursued vigorously.

OTHER LEGAL NOTICES
We will not file the details of your specific contract. Accordingly, we would recommend that you keep a note of these details and keep these with a copy of these printable terms and conditions. We reserve the right to change these terms & conditions from time to time and you should, therefore, refer to them each time you order goods from us. We shall be entitled to carry out any of our obligations through any other company which is part of our group of companies. We may also assign, transfer or sub contract any of our rights or obligations under these terms and conditions to any third party. You may not transfer, assign or sub-contract any of your rights or obligations under these terms and conditions, or any related order for goods, to any third party unless previously agreed by us in writing.
